2. General terms of use of the website www.emotion.tours

This User Agreement (hereinafter referred to as the Agreement) establishes the conditions and rules for the use by an individual (hereinafter referred to as the user) of the website www.emotion.tours (hereinafter referred to as the site), including the terms of use of materials posted on the site. The use of the site by a network user means that the network user accepts and undertakes to comply with all of the following terms of this Agreement. This Agreement, in whole or in part, may be changed by Sunshine Studio LLC at any time without any special notice. The new version of the Agreement comes into force from the moment of its publication on the website emotion.tours.

3. Terms of use of materials posted on the website www.emotion.tours

3.1. The site contains materials, trademarks and other legally protected materials, including, but not limited to, texts, photographs, videos, graphics, music and sound works. At the same time, the entire content of the site is protected by law as a work created by collective creative labor. Sunshine Studio LLC owns exclusive rights to use the content of the site (including the right to select, arrange, organize and transform the data contained on the site), except as otherwise noted in the content materials published on the site. Using any information from the site for any purpose other than personal, without the consent of Sunshine Studio LLC is not allowed.

3.2. The user may not copy, distribute, transfer to third parties, publish or otherwise use for commercial purposes material downloaded from the site without the written permission of Sunshine Studio LLC or other legal owner of the copyright. In case of obtaining permission to copy, distribute, publish or otherwise use the materials of the site protected by copyright, such copying, distribution, publication or other use is not allowed without reference to the copyright holder and/or trademark. The user may download materials from the site, the rights to which are owned by Sunshine Studio LLC, for personal use only.

Terms of use for the team, resources and partners

1. Terms of use of the company’s software / app used by the Emotion.tours Team

The company’s software / app, is developed to simplify and automate the collaboration of all team members, resources and partners for more effective work result of the overall team work. By using this software / app the user acknowledges the confidential nature of all information presented, undertakes to use it exclusively for his/her individual working purposes, and is personally responsible for its non-disclosure to third parties.

Payments & refunds Emotion.tours

1. Subject and general terms of the Agreement

1.1. This Agreement is a public offer, and if the conditions set out below are accepted, a user who accepts this offer pays for the services purchased on the emotion.tours website (hereinafter referred to as the website) established by Sunshine Studio LLC (hereinafter referred to as Emotion.tours) in accordance with the terms of this public offer. At the same time, payment for services by the user is an acceptance of the offer, which is considered equivalent to the conclusion of an Agreement on the conditions set forth in the offer (hereinafter referred to as the Agreement).

1.2. This Agreement is addressed to users who have reached the age of 18 and is an official and public offer of Emotion.tours to conclude an Agreement. Access to payment for services on the site by any person under the age of 18 is strictly prohibited. By paying for the services of Emotion.tours, the user declares and guarantees that his age is at least 18 years old.

1.3. If the user provides his personal data, he confirms his consent to the collection, storage and processing (accumulation, storage, clarification, use, destruction) of personal data. Such consent is provided for the entire duration of this Agreement. The user’s payment card data are not personal data and are not subject to collection, storage and processing by Emotion.tours.

1.4. This Agreement, in whole or in part, may be changed by Sunshine Studio LLC at any time without any special notice to users. The new version of the Agreement comes into force from the moment of its publication on the website.

2. Payment for services Emotion.tours

2.1. Payment for the services of Emotion.tours is made by the user by transferring funds using payment systems, as well as by cash. Payment for services can be made as a one-time online payment in the amount of the full cost of services, and a partial advance online payment, while the remainder of the cost of the service must be paid by the user on the spot before the start of the service. To pay for services, the user must follow the instructions on the website.

2.2. Emotion.tours has the right at any time after the publication of this Agreement to unilaterally change the list of payment systems, reflecting the specified changes on the website. All risks and adverse consequences associated with payment for Emotion.tours services through other payment systems are borne by the user.

2.3. The cost of services is fixed in EURO at the time of payment or prepayment. Payment is made by the user or third parties on behalf of the user in euros at the rate used by the payment system.

2.4. In order to avoid any kind of misunderstanding, Emotion.tours hereby declares and warns users that payment systems may charge any kind of commissions and fees in excess of the cost of the service object, setting the condition of acceptance when such commissions and fees are paid by the user. These commissions and fees are non-refundable. The user who made the acceptance is considered warned and agrees with this condition.

2.5. Tours to the Vatican Museums and the Colosseum require advance purchase of group admission tickets. According to the rules of the Vatican and the Colosseum, entrance group tickets are strictly tied to the date and time of entry, are NOT divisible and are NOT refundable. In this regard, the user can enter the Vatican Museums and the Colosseum only as a part of the relevant guided group.

2.6. Cancellation for participation in our tours without penalties is possible within 24 hours before the start of the service for Vatican tours and no later than 72 hours before the start of the service for Colosseum tour due to Colosseum’s tickets rules. The full or advance payment will be returned in full.

2.7. Tours are conducted in all weather conditions. In case of heavy rain, Emotion.tours reserves the right to slightly change the route, where possible, in order to spend part of the tour time indoors.

2.8. If, for reasons beyond the control of Emotion.tours, circumstances that do not allow Emotion.tours to properly fulfill its obligations to implement the service, Emotion.tours reserves the right to replace part of the range of services (for example, during a food tour, replacing one restaurant with another) while maintaining the class and quality of the service or providing a higher class service without additional payment.

2.9. The User has the right to send all claims for improper provision of services to the email hello@emotion.tours hello@emotion.tours

2.10. The User is fully responsible for the accuracy of the information and data specified when registering on the Site and paying for services.

3. Responsibility and guarantees

3.1. Emotion.tours is not responsible for violation of the terms of this Agreement if such a violation is caused by force majeure circumstances, including: actions of state authorities, fire, flood, earthquake, other acts of God, lack of electricity and/or malfunctions computer network (disruption of communication lines, equipment malfunction, etc.), illegal actions of third parties aimed at violating information security or the normal functioning of the site, strikes, civil unrest, riots, any other circumstances, not limited to those listed above, that may affect the implementation of the terms of this Agreement by Emotion.tours and beyond the control of Emotion.tours.

3.2 Emotion.tours strongly recommends that users take out travel insurance in case of cancellations and delays due to unforeseen circumstances or beyond the control of circumstances (eg inclement weather, strikes, seismic events). Users are also advised to take out medical and personal insurance in advance to cover any medical expenses, loss of luggage, loss of personal belongings or other similar accidents while traveling. Users agree that neither Emotion.tours nor any local partner operators will be held liable in any way for such unforeseen circumstances. All claims for reimbursement of insurance costs must go directly through the insurance provider and not through Emotion.tours.

3.3 During food tours, all responsibility for consumed drinks and food rests with the user. If the user has any special dietary or gastronomic preferences, he is advised to inform Emotion.tours in advance. Unfortunately our food tours are not suitable for users with gluten intolerances. If a suer has any allergies or any kind of intolerances to any product, he is strongly advised to check with the guide for the likelihood of its presence before proceeding to consumption. By paying for Emotion.tours food tours, the user agrees with this Agreement, which makes the tour participant responsible for the products consumed.

3.4 All disputes arising from legal relations under this Agreement shall be resolved through negotiations. In the event that the Parties do not come to a solution to the disputes that have arisen between them during the negotiations, such disputes must be referred to the appropriate court of the United States of America at the location of Emotion.tours with the obligatory observance of the claim procedure. The term for responding to a claim is 1 (one) month.

Privacy

Sunshine Studio LLC respects the rights of users to not disclose personal information and fully undertakes obligations to preserve personal data transmitted to company address. Emotion.tours is confident that users have every right to know about the policy and methods of processing information received while visiting and using emotion.tours.

1. Consent

Using the site or services you agree to the rules described in the text of the Privacy policy, including those related to the collection and processing of your personal data.

2. Collection of information

Emotion.tours may collect anonymous non-personal information provided by users that includes any non-concealed information that becomes available to Emotion.tours during access to the site and its direct use. Non-personal information may contain, among other things, data on the identification of the user’s browser, as well as the operating system, the procedure for visiting pages by the user, the time and date of the user’s connection, etc. This information is collected for statistics and is used to improve the quality of the services provided by the company, as well as to improve the usability of the site. The Company may collect personal Information, voluntarily and knowingly provided by the users during the creation of an account through the site or registering in any other way to receive the services. “Personal information” means personal information such as first and last name, mobile phone number, email address and special notes. For the avoidance of doubt, any non-personal information relating to or associated with personal information will be treated as personal information as long as such a relationship exists.

3. Use of information

Emotion.tours may use personal information to: (i) provide services; (ii) send messages to users regarding the services (for example, the location and start time of the provision of the services, etc.); (iii) provide users with support; (iv) send advertising materials to the target audience and communicate about promotional offers (hereinafter – advertising materials).

4. Disclosure of information

Emotion.tours undertakes not to disclose any personal information received from third parties. Despite this, it may disclose such information in the following cases: (a) to comply with the requirements of applicable law, regulation, legal process, or government requirements; (b) to ensure compliance with this Privacy policy, including investigating potential violations of these regulations; (c) to detect, prevent or resolve issues related to deception, security or technical aspects; (d) to respond to user requests for support; (e) to respond to claims that this or that content violates the rights of third parties; (f) to respond to claims that contact information (e.g. name, address, etc.) ) a third party was published or transmitted without its consent or as an insult; (g) to protect the rights, property or personal safety of Emotion.tours, its users or the general public; (h) if the company’s management system changes, including cases of mergers, acquisitions or purchases of all or a significant part of the company’s property. For the avoidance of misunderstanding, the company may transfer and disclose non-personal information to third parties at its sole discretion, including cases of merger, acquisition or purchase of all or a significant part of the company’s property.

5. Cookies files

While users visit the site, Emotion.tours may use industry-wide technology called “cookies”, which allows to store certain information on users’ computer or device. Cookies are small text files that can only be used by the website that created them. Cookies allow automatic login to the site: registered users will be identified automatically. Most Internet browsers have the function of clearing the computer of cookies, blocking their reception or sending a notification every time before saving such a file. 6. Safety

Emotion.tours pays a lot of attention to ensuring and maintaining the security of users’ personal information. Emotion.tours employs industry standard technologies and practices to ensure the security of user data and to prevent unauthorized use. Among other methods, user personal information is protected by firewall, encrypted protocol (SSL), and encrypted data. Despite this, the company cannot guarantee absolute data protection.

7. Changes to the Privacy Policy

The provisions of the Privacy policy are an integral part of this site. Emotion.tours reserves the right to change the Privacy policy at any time. In the event of significant changes, the Company will update the “Privacy policy” date posted at the end of the page for example in such way: ‘written by Emotion.tours on 18th April 2022’. Changes to this Privacy policy are effective from the date specified; by continuing to use the site after the release date, you agree to the changes made and to comply with the rules based on such changes.

8. Third Party Sites

The Site may contain links to other websites that are not part of the Emotion.tours site. They are independent, and the company is not responsible for their Privacy policy and other legal aspects of the use of such sites. We recommend that users familiarize themselves with the privacy policy on the sites of third parties.
